Terms of Service

1. Definitions

• "Platform" - RealEstate Pro website and mobile application
• "User" - Any person who accesses or uses our platform
• "Property Owner" - User who lists properties for sale or rent
• "Buyer/Tenant" - User who searches for properties and contacts owners
• "Credits" - Virtual currency used for contact reveals
• "Subscription" - Paid plan for unlimited contact reveals
• "Listing" - Property advertisement posted by an owner

2. Eligibility

To use our platform, you must:

• Be at least 18 years of age
• Have legal capacity to enter into binding contracts
• Provide accurate and complete registration information
• Not be prohibited from using our services by any applicable law
• Not be a competitor or using our platform for competitive analysis

By using RealEstate Pro, you represent and warrant that you meet all eligibility requirements.

3. Account Registration

• You must create an account to post properties or reveal contacts
• You are responsible for maintaining the confidentiality of your login credentials
• You are fully responsible for all activities that occur under your account
• You must immediately notify us of any unauthorized use of your account
• One person may not maintain multiple accounts without our permission
• We reserve the right to suspend or terminate accounts that violate our terms

4. Property Listings (For Owners)

When posting a property listing, you agree that:

• You are the legal owner or have explicit authorization to list the property
• All information provided is accurate, complete, and not misleading
• Property prices, details, and availability are truthful
• You will not post duplicate or spam listings
• You will not list properties that are already sold/rented
• You will promptly mark properties as sold/rented when no longer available
• We may remove listings that violate these terms without notice
• You grant us a non-exclusive license to display your property information

5. Prohibited Listings

The following types of listings are strictly prohibited:

• Properties that do not exist (fake listings)
• Properties that you do not own or have authority to list
• Properties involved in legal disputes or litigation
• Land/plots without clear legal titles
• Properties with illegal construction or violations
• Properties used for illegal activities
• Properties listed with fraudulent pricing or information
• Any listing that violates Indian real estate laws (RERA, etc.)

Violation will result in immediate account termination and legal action.

6. Contact Reveal & Credits System

• New users receive 3 free credits upon registration
• 1 credit = 1 contact reveal
• Credits are non-refundable and non-transferable
• Credits do not expire (unless account is inactive for 12+ months)
• You may purchase additional credits through our payment system
• Revealed contact information is for personal use only
• You may not share, sell, or misuse revealed contact information
• Misuse of contact information will result in immediate account termination

7. Subscription Plans

• Weekly Plan: ₹499 - Unlimited contact reveals for 7 days
• Monthly Plan: ₹999 - Unlimited contact reveals for 30 days (Best Value)
• Subscriptions auto-renew unless cancelled before expiry
• You may cancel anytime from your profile settings
• No refunds for partial subscription periods
• We reserve the right to modify subscription prices with 14 days notice
• Price changes will not affect active subscriptions until renewal

8. User Conduct

You agree NOT to:

• Harass, abuse, or threaten other users
• Post false, misleading, or fraudulent information
• Impersonate any person or entity
• Use automated bots or scripts to access our platform
• Attempt to bypass our contact reveal system
• Reverse engineer or copy our platform
• Use our platform for any illegal purpose
• Post spam, advertisements, or irrelevant content
• Collect user data without consent
• Interfere with the proper functioning of our platform

9. Intellectual Property

• All content, features, and functionality of our platform are owned by RealEstate Pro
• You may not copy, modify, or distribute our platform content without permission
• RealEstate Pro, logo, and design are our trademarks
• Property listings remain the property of the listing owner
• You grant us a license to display your listings on our platform

10. Termination

We may terminate or suspend your account immediately, without prior notice, for:

• Violation of these Terms of Service
• Posting fraudulent or fake property listings
• Harassing other users or misuse of contact information
• Attempting to bypass our credit/subscription system
• Any illegal activity conducted through our platform
• Request by law enforcement or government agencies

Upon termination, your right to use the platform ceases immediately. No refunds will be provided for unused credits or subscriptions.

11. Limitation of Liability

To the maximum extent permitted by law, RealEstate Pro and its owners, employees, affiliates shall NOT be liable for:

• Any direct, indirect, incidental, special, or consequential damages
• Loss of profits, revenue, data, or business opportunities
• Damages arising from property transactions between users
• Fraudulent or inaccurate property listings posted by users
• Disputes between property owners and buyers/tenants
• Technical issues, downtime, or service interruptions
• Unauthorized access to your account (unless caused by our gross negligence)

Our total liability shall not exceed the amount paid by you to us in the preceding 6 months, or ₹1,000 (whichever is lower).

12. Disclaimer of Warranties

RealEstate Pro is provided "AS IS" and "AS AVAILABLE" without warranties of any kind. We do not warrant that:

• The platform will be uninterrupted, timely, secure, or error-free
• Property listings are accurate, complete, or reliable
• Users are who they claim to be
• Any property transaction will be successful or satisfactory
• Results obtained from using the platform will meet your expectations

You assume all risk for using our platform and for any property transactions you enter into.

13. Indemnification

You agree to indemnify, defend, and hold harmless RealEstate Pro, its owners, employees, and affiliates from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from:

• Your violation of these Terms of Service
• Your violation of any third-party rights, including property rights
• Your property listings or transactions with other users
• Your misuse of our platform or contact information
• Any claim that your listing caused damage to a third party

14. Governing Law & Dispute Resolution

• These terms shall be governed by the laws of India
• Any disputes shall be subject to the exclusive jurisdiction of courts in Mumbai, Maharashtra
• Before filing a lawsuit, you agree to attempt informal dispute resolution by contacting us
• If dispute cannot be resolved informally within 30 days, either party may initiate legal proceedings
• You waive the right to participate in class actions against us

15. Changes to Terms

We reserve the right to modify these terms at any time. Changes become effective immediately upon posting. Your continued use of the platform after changes constitutes acceptance. Material changes will be notified via email or platform notice at least 14 days in advance.

16. Severability

If any provision of these terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

17. Entire Agreement

These Terms of Service, together with our Privacy Policy and Disclaimer, constitute the entire agreement between you and RealEstate Pro regarding your use of our platform and supersede all prior agreements.
